Hawaii law does require that your personal health insurance pay at least $5,000 in medical bills before you can receive a settlement for your pain and suffering.  Motorcycle collisions normally cause very serious injuries, so it’s rare that this $5,000 requirement is an issue.  

We do recommend that if you ride a motorcycle you purchase underinsured motorist coverage.  Far too many drivers in Hawaii do not carry sufficient liability coverage.  If you’re seriously injured in a motorcycle accident, you’ll be entitled to a large settlement for your pain and suffering, medical bills, wage loss, etc.  If the person who injured you does not have adequate liability coverage then it will be very beneficial if you have underinsured motorist coverage to make up the difference.

The best advice we can give you involves what you should do before you’re involved in an accident.  You should add No-Fault Insurance to your Hawaii motorcycle insurance coverage.  This insurance is also known as Personal Injury Protection (PIP).  In Hawaii, all auto insurance policies are required to include PIP coverage; however, it is not required for motorcycle insurance.  This coverage is optional; therefore, you have the choice of whether to add it to your policy or not.  It is not very expensive and it could save you a lot of money if you’re involved in an accident.   PIP coverage pays for the first $10,000 in medical bills.  It covers all types of medical treatment.  It not only covers hospital and doctor bills, but it also pays for physical therapy, massage therapy, chiropractic treatment, etc… You may think that medical bills are not a problem because you have personal health insurance.  Yes, it’s true that your health insurance will pay most of your bills; however, what many people don’t know is that when you get a settlement for your Honolulu motorcycle accident injuries, you will have to pay back your health insurance company for the bills that they paid.  

Here’s an example of why Personal Injury Protection coverage could save you money:  If you settle your case for $40,000 and you had the $10,000 in PIP coverage, then you would keep the full $40,000.  For those people in Hawaii who don’t have PIP coverage, if they settle their case for $40,000 and their personal health insurance pays the $10,000 in medical bills, then the injured person will have to pay back the $10,000 to their health insurance company.  This results in the injured person receiving only $30,000 of the settlement money instead of the $40,000 that they would have received if they had the No-Fault Insurance coverage.  

Not only can you end up with up to $10,000 more of your settlement money, but you will also be able to obtain different types of treatment that your personal health insurance may not cover.  For example, most health insurance policies don’t pay for the massage, chiropractic, or even acupuncture treatment.  It can even be difficult to get authorization to get physical therapy treatment.  

Obviously, once you have been in a motorcycle accident in Honolulu, or throughout Hawaii, it is too late to add Personal Injury Protection coverage if you did not already have it.  All you can do at that point is do the best you can to get the best settlement possible.  The first thing to do to ensure you get a good settlement for your injuries is to hire a lawyer.  You should not wait until you start to have serious legal questions about your case.  You should hire an accident attorney before you even call the insurance company.  This will be the best way to help make sure that you get the best possible settlement for your motorcycle accident injuries.
